BREAKING: Court clears path for police investigation of Ojudu, Adeyeye, Adeniyi, Omirin, others
• ‘Your suit is unmeritorious, premature and a classical abuse of court process’ says Judge
The High Court of Justice sitting in Ado Ekiti has dismissed the suit brought by Senators Babafemi Ojudu, Tony Adeniyi, Dayo Adeyeye and four others seeking to restrain the Ekiti State Police Command from investigating a petition on an allegation of perverting the course of justice written against them by the State Attorney-General and Commissioner for Justice, Olawale Fapohunda.
It will be recalled that Ojudu and others in several publications accused the Governor of Ekiti State, Dr John Kayode Fayemi and the State Attorney General, Olawale Fapohunda of colluding with the Justices of the Court of Appeal, Ekiti State division to relocate the sittings of the Court of Appeal from Ekiti State to Kaduna State for the purpose of delivering a contrived judgment in the matter of Senator Adebayo Adeyeye v Senator Biodun Olujimi.
In response to this allegation Fapohunda had written to the State Commissioner of Police requesting the police to investigate the matter given its seriousness. This led to the State police commands letter of invitation to Ojudu and seven others requesting that they respond to the petition. Ojudu and his colleagues subsequently approached the high court seeking. among others, an order nullifying and setting aside the letter of invitation.
In a 52-page judgement, delivered by Honourable Justice Bamidele Omotoso, the Court held that the act of rushing to court by ojudu and others was premature. The court noted that they did not answer or obey the invitation served on them even as the invitation was rescheduled for them on two occasions to state their own side of the criminal allegations and exculpate themselves. The court concluded that the suit by ojudu and others is unmeritorious and a classical abuse of court process. It accordingly dismissed the suit with costs of N50, 000 each in favor of the attorney general and the commissioner of police,Ekiti State.
With this decision and barring any further appeal proceedings, it would appear that the coast is now clear for Ekiti State police command to commence its investigation. In addition to Senator Babafemi Ojudu, others invited to present themselves for interrogation at the Ekiti State Police Command include Senator Tony Adeniyi, Senator Dayo Adeyeye, Bimbo Daramola, Robinson Ajiboye, Adewale Omirin, Femi Adeleye and Oyetunde Ojo
